1 - Without prejudice to the provisions of articles 49 and 50, the overnight stay and parking of motorhomes or similar is prohibited in Natura 2000 Network areas, protected areas and areas covered by Coastal Zone Management Plans, except in places expressly authorized for this purpose.

2 - In the rest of the territory and in the absence of municipal regulations for the activity, overnight stays by motorhomes approved by the Instituto da Mobilidade e dos Transportes, I. P., are permitted for a maximum period of 48 hours in the same municipality, except in places expressly authorized for the purpose, for which no limit on overnight stays is established.

3 - For the purposes of the previous paragraph, the following are considered:

a) 'Parking', the parking of a vehicle occupying a space larger than its perimeter;

b) 'Motorhome or similar' means a vehicle with a living space or adapted for the use of a living space, classified as a 'motorhome', 'special dormitory' or 'caravan' by the Instituto da Mobilidade e dos Transportes, I. P.;

c) 'Overnight stay' means the stay of a motorhome or similar, with occupants, between the hours of 10pm and 7am.

 

4 - Failure to comply with the provisions of paragraph 2 shall be punishable by a fine of (euro) 60 to (euro) 300, except in the case of overnight stays or camping in Natura 2000 areas, protected areas and areas covered by Coastal Zone Management Plans, in accordance with the provisions of paragraph 1, in which case the fine shall be (euro) 120 to (euro) 600.

5 - After the infractions provided for in paragraph 4 have been notified by the entity responsible for processing the infraction, the infractor may immediately make voluntary payment of the fine.

6 - Voluntary payment at the time of verification of the infraction corresponds to settlement of the fine at the minimum, and may be made by any means legally accepted as a form of payment, with preference being given to available electronic means of payment.

7 - The Government may promote the regularization of the overnight stay authorization referred to in paragraph 2 subject to daily registration on a free electronic platform that validates geolocation, keeping this record for a maximum period of 60 days.

8 - The electronic platform referred to in the previous paragraph must also be used for the purpose of electronically recording the validation of the places where the dirty water from these vehicles is regularly discharged.

9 - Failure to comply with the provisions of paragraphs 7 and 8 shall result in the penalty provided for in paragraph 4 being increased by 50 /prct.
