1 - Drivers must not start overtaking without making sure that they can do so without danger of colliding with a vehicle traveling in the same or opposite direction.

2 - In particular, the driver must ensure that:

a) The carriageway is free to the extent and width necessary to carry out the maneuver safely;

b) He/she can take the right without danger to those passing on the right;

c) No driver following in the same lane or in the lane immediately to the left has started to overtake him;

d) The driver ahead of him in the same lane has not signaled his intention to overtake a third vehicle or to go around an obstacle;

e) When overtaking cyclists or passing pedestrians who are circulating or on the verge, keep a minimum lateral distance of 1.5 m and slow down.

 

3 - To perform the maneuver, the driver must occupy the side of the road intended for oncoming traffic or, if there is more than one traffic lane in the same direction, the traffic lane to the left of the one in which the overtaken vehicle is traveling.

4 - Drivers must retake the right as soon as they have completed the maneuver and can do so without danger.

5 - Anyone infringing the provisions of the previous paragraphs shall be punished with a fine of (euro) 120 to (euro) 600.
