1 - Without prejudice to the provisions of articles 24 and 25 and any lower limits imposed on them, drivers may not exceed the following instantaneous speeds (in kilometers/hour):

2 - Anyone who exceeds the maximum speed limits is penalized:

a) If you drive a car or motorcycle, with the following fines:

1.º From (euro) 60 to (euro) 300, if exceeding up to 20 km/h, within the towns, or up to 30 km/h, outside the towns;

2.º From (euro) 120 to (euro) 600, if exceeding by more than 20 km/h and up to 40 km/h, within the towns, or by more than 30 km/h and up to 60 km/h, outside the towns ;

3.º From (euro) 300 to (euro) 1500, if exceeding by more than 40 km/h and up to 60 km/h, within the localities, or more than 60 km/h and up to 80 km/h, outside the localities;

4.º From (euro) 500 to (euro) 2500, if exceeding by more than 60 km/h, within the towns, or by more than 80 km/h, outside the towns;

b) If driving other vehicles, with the following fines:

1.º From (euro) 60 to (euro) 300, if it exceeds up to 10 km/h, within the localities, or up to 20 km/h, outside the localities;

2.º From (euro) 120 to (euro) 600, if it exceeds more than 10 km/h and up to 20 km/h, within the localities, or more than 20 km/h and up to 40 km/h, outside the localities;

3.º From (euro) 300 to (euro) 1500, if it exceeds more than 20 km/h and up to 40 km/h, within the localities, or more than 40 km/h and up to 60 km/h, outside the localities;

4.º From (euro) 500 to (euro) 2,500, if the speed exceeds 40 km/h within the localities, or exceeds 60 km/h outside the localities.

3 - The provisions of the previous paragraph shall also apply to drivers who exceed the maximum speed limits that have been set for them or that have been specially set for the vehicles they are driving.

4 - For the purposes of the preceding paragraphs, a driver who travels a certain distance at an average speed incompatible with compliance with those limits shall be deemed to have violated the maximum instantaneous speed limits, and it shall be understood that the administrative offense is committed at the point where the controlled route ends.

5 - Without prejudice to the provisions of the preceding paragraphs, when speed is controlled using a tachograph and the maximum speed limit allowed for the vehicle has been exceeded, the administrative offense shall be deemed to have been committed at the place where the control is carried out.

6 - Without prejudice to the provisions of article 26, on freeways drivers may not drive at an instantaneous speed of less than 50 km/h.

7 - Anyone driving at a speed below the limit established in the previous paragraph shall be punished with a fine of (euro) 60 to (euro) 300.
